Terms of Service

1. Acceptance of Terms

By downloading or using the BlueBlack Elite Fitness mobile application, or by purchasing a membership, you agree to be bound by these Terms of Service. If you do not agree, do not use the app or our services.

2. Membership & Subscriptions

  • Memberships are personal and non-transferable.
  • Subscription fees are charged in Nigerian Naira (NGN) and are processed by Paystack.
  • Memberships begin on the date of payment and expire at the end of the selected plan period.
  • Walk-in and short-term plans do not include a membership registration fee. Monthly and longer commitment plans may include a one-time registration fee.
  • Couple and family plans require in-person registration at the fitness center.

3. Payments & Refunds

  • All payments are final. We do not offer refunds for unused membership time except where required by Nigerian consumer protection law.
  • If a payment fails or is reversed without valid reason, your membership access will be suspended.
  • Paystack's own terms apply to payment processing. We are not responsible for payment processing errors on Paystack's side.

4. Membership Freeze

  • Eligible plans may allow membership freezing for a limited number of days per subscription period.
  • Freeze requests can only be made once per calendar month.
  • Frozen memberships pause your subscription end date by the number of days frozen.
  • Walk-in and 2-week plans are not eligible for freezing.

5. Facility Access & Check-in

  • Access to the fitness center requires an active membership and valid check-in via QR code or member ID.
  • The fitness center reserves the right to refuse entry to anyone displaying unsafe, disruptive, or disrespectful behaviour.
  • Operating hours are 6:30 AM – 9:00 PM, Monday through Sunday. Hours may change during public holidays.

6. Health & Safety Disclaimer

Exercise involves physical risk. By using our facilities, you acknowledge that you are physically fit to participate in exercise activities. BlueBlack Elite Fitness is not liable for any injury, illness, or loss that occurs during your use of our facility, except where caused by our gross negligence.

Consult a physician before starting any new fitness programme, especially if you have a pre-existing medical condition.

7. App Usage

  • You may only create one account per person.
  • You are responsible for keeping your login credentials secure.
  • You may not use the app for any unlawful purpose or attempt to reverse engineer, hack, or disrupt the app or its servers.
  • We reserve the right to terminate accounts that violate these terms.

8. Intellectual Property

All content in the BlueBlack app and website — including logos, design, text, and software — is owned by BlueBlack Elite Fitness. You may not copy, reproduce, or distribute it without our written permission.

9. Changes to Terms

We may update these terms at any time. We will notify you via the app or email for material changes. Continued use of the app after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be resolved in the courts of Abuja, FCT, Nigeria.
